The Legality Of Homeschooling

In the United States, children between the ages of five and 16 must either be enrolled in a public school or be part of a home based educational program that falls within the state standards. Just under 3% of all students in the US are home schooled, however, many parents are actually not the main parties that provide educational assistants to their children. Home based schooling is primarily used when the parents and guardians of school aged students are dissatisfied with the curriculum being taught at nearby public schools. While there are many experts that believe that home schooled children are not as socially developed as their peers the practice is completely legal. Members of certain religious groups such as Mormons are large proponents of home schooling. These groups are not in favor with the compulsory health related classes that most public school systems teach.

Each individual state has a set of rules that the parents of home schooled children must be compliant with. This usually includes the number of hours that each child must be instructed, but is also covers the courses themselves that must be taught. Some jurisdictions required home schooled students to be taught by instructors that are certified to teach in their particular courses of study. These measures have been enacted to prevent untrained tutors and parents that lack a formal education from interfering with the education process itself. Some states choose to regulate home schooling strictly while others have taken a more lax approach.

In order to see how home schooled students are progressing they must take a series of state sponsored tests. Referred to as standardized tests, students who are unable to successfully pass them after a predetermined number of tries may be forced to enroll in a public school. These tests can sometimes be administered by the parents themselves, but they can also be taken at a community center or a public school, depending on the state of residence. Colleges and universities have had various responses concerning the acceptance of home schooled students. Many public schools use a weighted GPA to rank their students academically. This becomes a challenge for home schooled students because there is often not a basis of comparison. Some parents seek out institutions of higher learning that have shown their receptiveness to home schooling, but the majority of home schooled students end up taking all of the classes and tests needed to have their applications accepted.

The only time that home schooling becomes illegal is when it is found that students are not getting the required level of education. Usually, these students are immediately enrolled in the closest public school but they can also be removed from the home if it is found that they are several years behind.
